Delta-8 THC gummies are all the rage right now.
For those unfamiliar, Delta-8 THC is basically going through what CBD went through back in 2018. It offers all the benefits of other cannabinoids — plus a hefty dose of side-effect-free relaxation.

What is Delta-8 THC?
Delta-8 THC is basically the sibling of ‘regular’ THC (also known as delta-9).
Delta-8 and delta-9 are considered isomers, which means that they have the very same molecular composition in a slightly different molecular arrangement. The only difference? A single chemical bond.
Yet this slight difference is enough to make delta-8 work and feel noticeably different than delta-9. It’s known for providing a pleasantly refined high — a high that’s free of paranoia-like side effects or the infamous ‘couch-lock.’
The National Cancer Institute explains that delta-8 THC has a wide variety of potential health benefits, including “anxiolytic, antiemetic, appetite-stimulating, analgesic, and neuroprotective properties.”
Recent research explains why. Leading cannabinoid scientists have found that delta-8 THC binds to CB1 receptors (like regular THC) and CB2 receptors (like CBD).
This unusually diverse bonding affinity is what makes delta-8’s high so mellow.
Delta-8 regulation state by state
While delta-8 THC is legal on the federal level, several states have either banned or restricted its sales. In many areas, law enforcement is hostile to delta-8 THC, since in their eyes it’s just another cannabis-related ‘drug.’
The following states have either banned or restricted access to delta-8:
- Rhode Island
- North Dakota
- New York
In addition to the 16 states above, five more states appear poised to ban delta-8 soon:
Also keep in mind that delta-8 THC rules and regulations are always changing. The legal landscape surrounding this cannabinoid may look very different a year from now.
Where you can buy delta-8 THC (legally!)
As of September of 2021, delta-8 THC is still fully legal in 28 states (and one district):
- New Hampshire
- New Jersey
- New Mexico
- North Carolina
- South Carolina
- South Dakota
- West Virginia
- Washington DC
Once again, delta-8’s legality is always changing. So check in on our blog to stay up-to-date on these changes as they happen!

It can be hard to find good delta-8 THC products. The industry is newer and less regulated than the CBD sphere is.
